Welcome to WukongDojo.AI (the “Service”). These Terms of Service (“Terms”) are a binding agreement between you and WukongDojo (“we”, “us”, “our”). By accessing or using the Service, including by signing in, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, whichever is higher. Users under 18 must have permission from a parent or legal guardian. You must provide a valid email address through our single-sign-on flow and may only register one account per person unless we agree otherwise in writing.

2. Your account

We authenticate you through third-party single-sign-on providers. You are responsible for the security of the underlying account you use to sign in. You agree to provide accurate information and to keep it up to date. You may close your account at any time; we may suspend or terminate accounts that violate these Terms.

3. What the Service does

WukongDojo lets you (a “builder”) create, run, and optionally share AI agents. Agents run on large language models (“LLMs”) provided by third-party platforms such as OpenRouter, OpenAI, Anthropic, and Google. When you or your invitees use an agent, the prompts, conversation history, attached files, and configuration are transmitted to those providers to generate a response.

The Service is offered in three modes:

We may also enforce the acceptable-use policies of the underlying LLM providers. Activity that violates those policies may be blocked or flagged independent of these Terms.

5. Your content; license to operate

The agents you create, the prompts you write, and the conversation history they produce are yours (“Your Content”). You retain ownership of Your Content. We do not read Your Content to improve our product, train models, or analyze the market.

To run the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Your Content solely to (a) operate the Service for you and your invitees, (b) transmit it to the LLM providers you have chosen, (c) display public agents on WukongGPT when you mark them public, and (d) keep backups and operational logs. This license ends when you delete Your Content or close your account, except for backups and aggregated, de-identified records that we may retain for a commercially reasonable period.

6. Third-party LLM providers

The Service is a pass-through to third-party LLMs. When an agent is run, the prompt and relevant conversation history are sent to the chosen provider, processed under that provider's terms and privacy policies, and the response is returned to you. You are responsible for understanding the policies of each provider you select. We are not responsible for the availability, accuracy, or content of provider outputs, and provider downtime, rate limits, or policy changes may affect your agents.

6a. Reliability fallback

When the LLM provider or model you have configured is unavailable, times out, or returns a rate-limit error, the Service may transparently retry your request against a comparable model (possibly from a different provider) in order to fulfill the request reliably. The fallback model is selected for similar capability and may carry a per-call cost that is higher or lower than the model you configured. Fallback usage is billed exactly the same way as your nominal model: provider cost plus the 9% platform margin per Section 7, with no separate fee. To protect your wallet, the fallback model's per-call cost will not exceed two times the cost of the model you configured; if no model within that range is available, the Service will return the original error rather than substitute. The Service will not retry against a model that the underlying provider's policies would otherwise refuse to run. Fallback is best-effort; we do not guarantee that any specific request will succeed.

7. Payments, wallets, and subscriptions

Payments are processed by Stripe under Stripe's terms. We do not store full card numbers. WukongDojo runs on a pay-as-you-go wallet model:

8. Sharing agents and inviting others

When you share or publish an agent, you are responsible for what that agent does. You confirm that you have the right to use any third-party content embedded in the agent (knowledge files, brand assets, datasets) and you are responsible for any messages exchanged through it. Recipients of your share links may, on first use, be asked to agree to these Terms; their use is at their own risk.

WukongDojo is an expert-services marketplace — builders publish agents as an extension of their professional practice (consultant, coach, therapist, tutor, advisor, or similar). Anyone who uses an agent built by another person should understand that the builder of that agent can read the full conversation, including any files, images, or personal information shared in the chat, and can see the end-user's username, display name, and conversation metadata (timestamps, message counts, and any earnings the conversation generated for them) on their agent-management and billing surfaces. The builder does not see the end-user's email address. Do not share information with an agent that you would not want its builder to see, and do not chat with a specific builder's agent under a signed-in account if you require anonymity from that builder. End-users may delete any conversation at any time from their chat history; deletion removes the conversation from the builder's view as well as the end-user's own. Builders accessing end-user conversations remain bound by Section 4 (Acceptable Use) and by applicable law in their handling of that information.

9. Intellectual property

The Service, including its software, interface, brand, and the “Wukong / 悟空” family of marks and tier names, are owned by us or our licensors. Nothing in these Terms grants you any right in our marks or software except the limited right to use the Service. You may not republish, resell, or rebrand the Service or its methodologies without our written consent.

10. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that LLM outputs are accurate, complete, current, safe, or appropriate for any purpose. You are responsible for evaluating outputs before relying on them, especially for medical, legal, financial, or safety-critical decisions.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred US dollars (USD 100).

12. Indemnification

You will defend, indemnify, and hold us harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service, including the agents you build and share, or (c) your violation of these Terms or any law.

13. Termination

You may stop using the Service at any time and close your account. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law or by a provider. On termination, your right to use the Service ends, but Sections 5 (license, last sentence), 9–12, and 16 survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and may be announced in-product. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service is the state and federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you have under the laws of your country of residence.

16. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
